His first suspension came in , where he was caught on film smoking marijuana. Many think the marijuana was simply an excuse to get rid of Orton for a bit, as he was known for having one of the worst attitudes in the locker room at the time.

Though it is his third suspension by the organization, it is only his second suspension to be classified as a Talent Wellness Program infraction. He smoked marijuana backstage at the March 28, SmackDown taping, which company employee Bruce Prichard discovered and reported to management. Orton addressed the matter during an interview published in the September issue of WWE Magazine.
